Collaboration & Mediation: Alternative Ways To Resolve Your New York Family Law Matters

There are many more efficient alternative dispute methods to resolving your divorce or family law matter than traditional litigation. The two most common include the following:

Mediation

Mediation is very popular in New York. With mediation, a neutral third party, known as the mediator, helps both spouses reach an agreement outside of court.

Courts have embraced the method of dispute resolution, claiming its efficiency and costs effectiveness. However, the mediated result places emphasis on the agreement, not necessarily the terms. A bully can take advantage by being uncompromising. Mediation doesn’t require an attorney but it’s vital to having one at your side to advocate for your rights.

Collaborative Law

Collaborative law has many attractive qualities, but it can be expensive. Like mediation, the collaborative process involves reaching an agreement outside of court, but each spouse has a separate lawyer who commits to settle the case without going to court. If the case is not settled, the clients start over, often with high litigation expenses.
